This Privacy Policy applies to data processing by MCT Agentur GmbH (“responsible person”, “we” or “us”) regarding the Pitchfork Website (www.pitchforkmusicfestival.de). 3. PURPOSES OF DATA PROCESSING, LEGAL BASES AND LEGITIMATE INTERESTS PURSUED BY US OR A THIRD PARTY, AS WELL AS CATEGORIES OF RECIPIENTS

3.1 Informational Use of Our Website

When you visit our website, the browser used on your device automatically sends information to the server of our website and temporarily saves it in so-called log files. We have no influence on this. The following information is collected without your intervention and stored until it is automatically deleted:

  • the IP address of the requesting Internet-enabled device,
  • the date and time of the access,
  • is the name and URL of the called file,
  • the website from which the access was made (referrer URL),
  • the browser you are using and, if applicable, the operating system of your Internet-capable computer as well as the name of the access provider.

The legal basis for the processing of the IP address is Art. 6 para. 1 lit. f) General Data Protection Regulation (“GDPR”). From the collected data no conclusion about your identity is possible and we do not draw such conclusion. Our justified interest in data collection is to be seen in the following purposes:

  • Ensuring a smooth connection setup,
  • To ensure a comfortable use of our website,
  • Evaluation of system safety and stability as well as
  • other administrative purposes.

3.2 Data Processing for Advertising Purposes (Sending of Our Newsletter)

If you have given your consent, we will use your name and e-mail address to send you our newsletter and advertising for the Pitchfork Music Festival Berlin.
In order to ensure that no errors have been made when entering your e-mail address or that your e-mail address has not been misused, we use the so-called double opt-in procedure. This means that after your registration we will send you an e-mail to the given e-mail address asking you to confirm that you wish to receive the newsletter. If you do not confirm your subscription within 24 hours, your information will be blocked and automatically deleted after one month. In addition, we store your IP address and dates of registration and confirmation.
We use the rapidmail service to send our newsletter. Your data will therefore be transmitted to rapidmail GmbH. It is prohibited for rapidmail GmbH to use your data for purposes other than sending the newsletter. rapidmail GmbH is not permitted to pass on or sell your data. rapidmail is a German, certified newsletter software provider which has been carefully selected in accordance with the requirements of the GDPR and the BDSG (Federal Data Protection Act).
You can revoke your consent to the storage of data and its use for sending the newsletter at any time with effect for the future, e.g. via the unsubscribe link in the newsletter or by e-mail to: hartmann@mct-agentur.com.

3.3 Online Presence and Website Optimization

3.3.1 Cookies – General Information

We use so-called cookies on our website on the basis of Art. 6 para. 1 lit. f) GDPR. Our interest in optimizing the website is deemed to be justified within the meaning of the aforementioned provision. Data processing takes place on the legal basis of Art. 6 para. 1 lit f (legitimate interest) of the GDPR. Our legitimate interest lies in the optimization of our online offering and our website. Since the privacy of our visitors is particularly important to us, etracker anonymizes the IP address as early as possible and converts login or device IDs into a unique key that is not assigned to a specific person. etracker does not use them for any other purpose, combine them with other data or pass them on to third parties.
